Özet: Problem Statement. Kazakhstan seeks to create a new national, innovations oriented economy, which could provide a competitive position in the world markets. In order to reinforce the effectiveness of this direction, it is necessary to improve institute of intellectual property rights protection.Thus, the study of researcher’s rights protection in the innovative development of Kazakhstan economy is of utmost importance and need for a comprehensive study of the named issue.Purpose of Study. Study of the experience of formation and development of the institution of intellectual property rights protection in Kazakhstan and development of practical recommendations on its improvement.Methods. The techniques such as analysis and synthesis, system and structural-functional approach, statistical methods, etc. are used in the article.Findings and Results. The article describes the formation and development of the institution of intellectual property rights protection in Kazakhstan. The current status with patents in the Republic of Kazakhstan, as well as a comparative analysis with other developed countries in the world are considered, conclusions are made and practical recommendations, with the aim to facilitate the effective development of this aspect of innovation development of Kazakhstan's economy, are stated.Conclusions and Recommendations. The main reason for the lag in Kazakhstan in terms of patent activity is that the individuals and entities, due to a significant limitation of funds and, in part, because of their special legal status and low literacy in the field of intellectual property, patenting abroad is often quite cumbersome process.Thus, for the successful implementation of innovation policy of the country the Government of Kazakhstan should strengthen the role of intellectual property as a driver of innovation development through:-Determining the transfer of property rights for the research results, which were financed by the state, to the state enterprises or private entities;- Establishing the incentives for innovation activity through protection of the researchers and scientists’ rights and creation of conducive conditions for production the products by the companies, based on the results of their research;- Developing specific recommendations that will allow research organizations to better understand the capabilities and limitations of using intellectual property rights;- Facilitating the preliminary assessment of intellectual property rights in the Fast Track;- Using of information received from the application of intellectual property rights in order to improve understanding of the effectiveness of the initiatives on support of innovations and innovations activity in general.
