Özet: In the criminal justice and in the criminal science the doctrine of the exclusion of evidence is about the issue of using evidences being sensitive to the human rights or being obtained in breach of the rules of the code of criminal procedure. The conflict between the fundamental rights of a person on the one hand and the interest in an effective criminal justice on the other hand appears in every society and in every legal system all over the world. The legal practice pragmatically follows an appreciation of values and considers the exclusion of evidence as an exception. The fundamentals rights of the accused calls for the exclusion of evidence though. Besides there is the core area of private conduct of life, the privacy issue. It is not allowed to affect this area of a person by any investigation measure. Statements concerning this area may not be used in a criminal case.
