Özet: The insurer's obligation to inform before the contract is regulated by Turkish Commercial Code Article no. 1423. Pursuant to this article, the insurer and its agent shall be obliged to inform the insurant all the relevant information regarding the insurance contract, the rights of the insured, the provisions that the insured should pay special attention to, and the notification obligations related to the developments, in writing before the establishment of the insurance contract. In the event that the insurer violates this obligation, the legislation grants the right to withdraw from the contract to the insurant, but subjects the use of this right to a duration of 14 days. However, according to the decision of the Court of Justice of the European Union dated 19.12.2013 and numbered C-209/12, the insurant may withdraw after the contract without any limitation on duration, if the insurant is provided with incomplete or no information by the insurer within the framework of the contract negotiations regarding “the conditions, duration and procedure of exercising the right of withdrawal”. In this study, the highly controversial decision of the Court of Justice of the European Union will be examined and possible effects on Turkish Insurance Law will be discussed.
