Özet: In addition to the process before the signing of the collective agreement, which is a tool for workers to organize and improve their working conditions, it is also important to ensure the continuity of the agreement. One of the situations that this continuity is likely to affect is the change of the employer who is a party to the contract. In this study, the situation of the collective agreement applied in the current workplace or in the current workplace of the acquiring employer within the framework of Article 38 of Law No. 6356 will be examined. In addition to the possibilities mentioned in the article, the periods before the signature of the contract were included in the study. Then, the rights of the workers who have been transferred from subcontractor to public employers are examined.
