Özet: There are provisions concerning (governing) associations in Turkish Civil Code, Law on Associations, Regulation on Associations and also in addition to these legislations, in Turkish Commercial Code and Corporate Income Tax Law. It was held in Civil Code No. 743 that associations could operate commercial business that serve  Okan Üniversitesi Hukuk Fakültesi Medenî Hukuk Anabilim Dalı Öğretim Üyesi their purposes and the associations which operate commercial business were subject to the provisions about partnerships of commercial law. However, these provisions are not transferred to the Turkish Civil Code. This situation constitutes conscious or unconscious breach of law, rather conscious silence? Answer to this question below will be required.
