Özet: According to article 7 of anti-terror law (TMK), members of the terrorist organization shall be punished under Article 314 of the Turkish Penal Code. However, active repantance provisions set out in Article 221 of the Turkish Penal Code shall be applied to a terrorist organization member who gives information about the terrorist organization by showing active repantance and shall not be punished for crime of membership of terrorist organization or penalty discount. Account to this article, for impunity, member of terrorist organization without commit within the framework of terrorist organization's activities, voluntarily must report to the relevant authorities (221/2), member of terrorist organization without commit within the framework of terrorist organization's activities, if who arrested, in framework of active repantance, must information to relevant authorities that is suitable to dissolution of terrorist organization or arrest of members of the organization (221/3) or if who voluntarily give in, must information to relevant authorities about structure of terrorist organization and committed crimes within the framework of the organization's activities (221/4). If who give to information about that mentioned in this article after who captured, only discount penalty for related person. for active repantance, membership of terror organizations must give to useful information about terrorist organizations sincerely. In this article, firstly the concepts and explanations about criminal organization, terror, terrorist organization and membership of terrorist organization are given, how to apply active repantance provisions in the crime of membership of terrorist organization are told.
