Özet: Hospitals and other areas where healthcare workers work include many dangers and risks. One of these risks is violence in health. According to the opinion published by the Ministry of Health of Turkey, violent cases are not qualified as occupational accidents for different reasons. However Ministry of Labor and Social Security gives opinion otherwise. Based on this view, the Ministry of Health has made more realistic assessments of violence, but has not been able to meet the requirements of the law. Our study was carried out in order to demonstrate whether violence in health would be considered as a occupational accident according to relevant official writings, practices of the Ministry of Health and scientific and legal backgrounds. As a result, when the violence incident was assessed according to the definition of the occupational accident and the opinions of the other institutions, The relevant law text was found to bear all the conditions of the occupational accident. In this context, it would be right for the ministry of health to reconsider the topic and put forward a more realistic and constructive opinion and practice.
